I changed my employer after 9 months of filing 485 using AC21 a year ago and my new employer has reduced my workdays to 3 days a week starting this month. Can I get a second job for 2 days a week with same job description and salary etc ?
The AC21 job must be same/similar along with permanent and full-time. Your labor should indicate hours/week for the job. Usually CIS considers job with > 35 hours per week as full time.

I will be completing my first 3yrs of H1 in Sept 2010. My I-797 is valid till Sept 2010. I-94 & H1 visa expired on April 4th 2010.
My company has applied for 1-129 on April 1st 2010.
I have a few questions -
1. Since my 1-94 is expired and H1 too, am "I out of status"? - I-129 is still pending, I have received the receipt from USCIS on April 12, 2010.
2. If I am out of status, is it going to effect my visa renewal or H1 extensio?
3. What to do?

Hi,
On the USCIS website, it mentioned "normal processing time" in the following statement. I am wondering what is the normal processing time for I-485. I can't find it. When the published processing time is current for a case, how long it will take for a case to be approved?
My case suddenly becomes current for a month with the sudden forward movement of the processing time. I am wondering how long should I wait before I contact USCIS about my case if I do not hear anything from them.
When is name check initiated? When the case is received or when the case processing time becomes current?

If at any point your case should become more than 30 days outside our normal processing time, and you haven't received a written decision or update from us within the last 60 days, you can help us by calling customer service and letting us know. Thanks FactoryMan. I had a similar question. My thought is that if the spouse is a dependent, then it shouldn't matter what status s/he is, as long is it is legal.
The next question is, suppose we apply for EAD, but the spouse's current student status expires before receiving the EAD, do they fall out of status?
