Dont take my words or advise for granted if one year you had less than your prevailing wage on W2 it may be ok as you have 2 more years of W2 with equal or more than prevailing wage.
Honestly I cannot say for sure your extension will be denied. But it helps for you to pay a couple of hundred dollars and talk over the phone to experienced attorneys like Sheela Murthy and get advise on your situation and options and whether there are chances of denial. I would assume you are OK but again I am no LAWYER :) I really wish you luck in your extension

I hear you, I've been in this country for last almost 10 years now. Came here to do my MBA too. The journey that began on Aug 2, 1999 is still continuing as of Aug 19, 2008... Anyways, best of luck to both of us.

I worked for my employer at this vendor. At the time, my employer agreed on paper to give me a specified amount but only after the vendor pays. Vendor has been giving him troubles as regards my pay, so my employer made me wait frustratingly for months to give me pay. Just recently only after much trouble he released part of the amount. But now he learnt that he might have to go to court about the vendor. As a result, now he is denying me MY remaining pay!! I already waited for 4 months now, and can NOT take this strain anymore. My friends advised me to take this issue to Court or DOL. But my employer threatens that I will have no case.
Is that so?? Am I really required to wait like this months/years long if it takes that long for my employer to settle his matter with vendor?? Can an employer actually follow these kind of practice? Please provide your experienced advises.
Also kindly let me know how can I proceed if I want to file a DOL complaint?

Regardless of whether everyone gets their Green Cards or not, the numbers should definitely see a substantial jump.
we are entering into the last quarter, where according to the new rules, everything that has not been allocated will be opened up for retrogressed categories for that FY.
Which actually explained why they pushed EB2 so far back, so that they can bring it forward in the last quarter, i.e. the July bulletin.
On the whole issue of EB retrogression, This current batch of EB based green cards have waited the longest number of years in the history of green cards.
So, sooner or later, someone in the goverment will have to answer why is that they let so many people apply green cards when they did not have a numbers solution ready.
Why were we even allowed to file for Green Cards when they could only issue a certain number based on the Country of Birth, each year.
This is like sell a product to someone, send him an invoice, and he comes back and says, sorry, we have a country wise quota, so even if we bought these goods from you, we wont pay you cos the quota for this year is up.
No, literally, export quotas work that way, they put a quota on sourcing, not on payments.
Why not do the same on Green Cards?
So, this whole mess, what is the right amount of time (in years), that it starts turning into a 'rights' issue from a 'flawed process' issue.
Currently, unless we have some representative in the government, who sees this flaw as a real issue, it is only us non-immigrants who can push this harder, and generate that representative, who instead of sliding this issue along with some big Financial bill, lobbies hard to get this issue resolved, as a separate entity..
ON the hope that OP has generated, personally, Am I hopeful, that I will get my Green Card in July.

I have answered that question many time on this forum. USCIS, lawyers and other forum guests have not been able to answer the question of what happens to an H1 extension when the underlining I140 is revoked. So I guess the H1 is not revoked.
That sounds like a great idea except what would happen if you transfer the company and the current company revokes your I-140. The 3 year H1 extension is based on the approved I-140 but if that underlying I-140 is revoked, would the H1-B still valid or is that one of those gray areas?
I personally really like this idea. Thanks a lot for this suggestion. Didn't think of that before.

Please let me know the way to contact USCIS. Phone number or mail id. I tried contacting them through the 1800 number but it is an automated system, there is no human to talk to.
I had problem with I94 and used the services of USCIS field office (San Jose) to get it fixed.
If you want to follow my approach, you may find field office using this URL, get an appointment there, discuss it (that you are in US and check your records, if shows outside US, get it updated) and handover I-102.

u can use AC21 in 2 ways.
one -change employer with ur H1b
two -change employer with EAD if you have one.
EAD is not necessary for AC21. EAD is a way not to transfer H1b and change employer,but you will need to renew this every year, EAD is temp green card while on H1 status.
If you pass 180 days after 485 filing , it will remain valid if your 140 is approved and is not revoked before 180 days from 485 filing.
- Is it safe to transfer H1 (after 180days) without AC21?
- How will it affect my 485?

you should ask the SSA office to accept the application and send it to DC for verification (manual process). They have that option available.
i think you should do that, since there would be no point in waiting if you have to do this after Dec 31 due to some technical error.
Also, the person can work without an SSN. it's not mandatory to have SSN to get paid.

Yes, I am aware that once we get the RFE we could/should send the Medical papers.
My Q is more of pro-actively sending in the Medical Papers as they will expire by June 2008 and we are not sure that there will be an RFE before that.

hello all,
Lets say you are a citizen here or your son is a citizen becasue he was born here.
Then you decide to go back and he starts studing with the PIO, I guess that works till he gets to college(Govt colleges are NRI quota right?)
Then when he want to work there dose he have to get a VISA like us comming here to work ?
I ask this becasue a friend of mine said a major IT company in India said that such a person cannot work in India without a VISA and they are not sponsering any visa's now.
so when he tried to come to the US, it seems that he had to pay for all his education as an NRI would have paid.
also if you reject the US citizenship and US is not going to give you any visa..ever !

and it mentions at the end
'You must submit the requested information within tweleve(12) weeks from the date of this letter. Failure to do so may result in the denial of your petition.'
so if we count 12 weeks from Jan 8, it is going to be 84 days which is going to finish by April 2nd.
If the RFE response reaches by say this Monday i.e Apr 7th will it be OK?
The reasons for delay are financial adjustments.
He is now going to send the tax returns for 2007 which has been asked.
