My GC is based on future employment. I am working for company A on H1, company B has applied I 485 and I 140 also approved. I will be completing 5 years of H1 early next year.
My question is:
Can company A apply my H1 extension for 3 more years based on my pending I485 and approved I140?

My situation,
I am having Bachelor Of Science in Nursing degree from US unviersity.
I have state board nursing license (RN NcLex) from NJ.
Do I still need CGFNS VIsa Screen?

Hello,
I am going to Chennai for my visa stamping and the consulate website says that I need to present the " complete I-129 petition submitted by your prospective employer including the Labor Condition Application " during the interview. Can any one tell me if the photocopy of those documents will do or do I really need to carry the originals (which I don't have)?

It looks like you are getting glare from glass or something. Get as close to the glass as you can and the lens as perpendicular as possible. A dark cloth and duct tape to put it up with would get you two things: (1) ability to block glare from lights behind you and (2) hide you from the birds so they settle down.
I've actually put the camera on a tripod and draped a large towel over it and my head/torso for camoflage, which let me stand outdoors and get closer without scaring them away. But I don't do that much because it's really tiring standing there, motionless :)
For the most part, a flash doesn't seem to bother birds much and it's a great help - you get better contrast and a faster shutter.

Here is my situation:
1) GC process thru company A, I 140 approved,I 485 filed and had valid H1B (expired on 12/28/2009)
2) Switched to Company B using AC21 and using EAD.
3) I would like to file H1B also based on previuosly approved 140 thru Company B as a back up since my previous employer going to revoke my 140.
Since my previous H1B expired few week back,is it posible to file new H1B thru Company B at this point?
Please advise

USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...
That is because their entire revenue comes from filing fees (2.5 billion out of the 2.6 billion dollars). Why would they make changes when they get easy money? It is a win-win for them - by both delaying the processing of the original application and by reducing the validity of the interim benefits, they prolong the money flow.
Don't expect any reform from Congress because they are the ones who allocated the filing fees revenue to pay for the USCIS expenditure.

Unfortunately , it is true. I personally know a friend whose I-485 was denied even without issuing any NOID or RFE. Reason, well its very obvious, the underlying I-140 was revoked, even though it was past 180 days. By law, your supposed to get NOID or RFE. but some IOs are ignorant and do not know the AC21 laws properly. So they issue straight denial. The number of cases are few because not many companies revoke I-140 past 180 days. But few companies do and some have to do it. So in these situation yes, chances are that you will get a straight denial and that is why there is thread to lobby efforts to raise some concerns to Ombudsman about these erroneous denials.
The intensity of denials is on rise now and also intensity of 140 withdrawals from ex employers is on rise.
